By submitting your photo and associated information, you agree to the following Terms and Conditions for yourself and associated minor children contained in such photo submission. Please review all the Terms and Conditions here. There are no prizes for participation.
I hereby acknowledge that I am the parent or legal guardian of any minor(s) in my photograph submission, or I have the consent of the parent or legal guardian of the minor(s) in my photograph submission to submit the photograph pursuant to the terms below.
On behalf of myself and any minors, as the “Submitter” of the “Photograph” as part of “Photograph Submission”, I hereby irrevocably consent, grant, license and give my permission to Little League Baseball, Incorporated (hereafter “LLB”), its affiliates, successors, and assigns (and their employees, officers, directors and agents or contractors), and any third party which LLB determines in its sole discretion to be appropriate including, but not limited to, ESPN entities, Major League Baseball and their affiliated entities, and any and all sponsors and/or licensees of LLB a royalty free, irrevocable right and license, to use, exploit, adapt, modify, sell, sublicense, reproduce, record, photograph, digitize, distribute, publicly display, publicly perform, and create derivative works, throughout the world in any and all forms whether now known or later developed, the image, name, voice, likeness or persona of the above listed minor(s) in any and all commercial exploits or ventures, promotional materials or announcements, publications, media releases, or advertisements, electronic or otherwise in any medium now known or hereafter developed (“Work(s)”), in perpetuity throughout the universe, and waive any and all rights to the same.
I acknowledge and agree that neither the associated minors nor I will receive any compensation whatsoever if such image, name, voice, likeness or persona appears in any Works, or from any proceeds of any utilized Work. I acknowledge and agree that any use of such image, name, voice, likeness, persona, or resulting Work is solely the property of LLB in perpetuity. In addition, I acknowledge and agree that LLB may, without my permission or advance notice to me, supply such image, name, personal information, voice, likeness, persona or resulting Work to any third party which LLB determines in its sole discretion to be appropriate, for any use, publication, and/or offer of information, programs, and/or services to you or anyone else.
To submit your photo, you agree to visit (the “https://www.littleleague.org/PhotoContest/” and or “https://www.littleleague.org/GirlsWithGame50/“) and follow the on-screen registration instructions. You will be required to complete the necessary information include parent / guardian information such as his or her name, e-mail address, phone number, mailing address, date of birth and to upload to the Website a photograph that relates to the sport of baseball or softball. No photographs will be accepted by participants under the age of 18.
There is no limit on the number of times each person may submit photographs, but each photograph must be different.
All Photographs must comply with the following guidelines: (a) the Photograph must be in a .jpg or .png, file format with a maximum file size of 25MB; (b) the resolution of the Photograph must be at least 300 dpi; (c) the Photograph (including the copyright in the Photograph) must be owned by the person submitting the photo and must be original; (d) the Photograph must have been taken by the Submitter and must not previously have been published for commercial or editorial purposes in any commercially-produced publication (e.g., magazines, websites) or have won any award; (e) the Photograph must not depict or refer to any brand or trademark other than Little League Baseball and Softball; (f) the Photograph must not contain any material that is defamatory, threatening, indecent, violent, obscene or offensive, or that promotes a political agenda; (g) the Photograph must not contain any material that violates or infringes upon the rights of any third party, including without limitation copyrights, trademarks or rights of privacy or publicity, or that is unlawful, in violation of or contrary to any applicable laws or regulations, or whose use by the LLB as noted below in Photograph Uses requires a license or permission from or payment to any third party; (h) if the Photograph identifies or depicts any person other than the submitter, the submitter must have prior to submission obtained written consent from such person (or his or her parent or legal guardian, if the person identified or depicted is a minor) to the use by the Licensees of the Photograph including such person’s name, image and/or other identifying information; and (i) the Photograph must not contain any material that LLB, in their sole discretion, deems inappropriate for public viewing. By submitting a Photograph, you represent and warrant that you have complied with all of the foregoing requirements and have obtained all permissions, licenses and consents that are necessary for the submission of the Photograph and the use of the Photograph as permitted and to verify compliance with the foregoing requirements. Each submitter agrees to provide to LLB at LLB’s request copies of all such permissions, licenses and consents. LLB reserve the right in their sole discretion to remove or delete any Photograph that LLB determine does not comply with these guidelines, and to make such changes to any Photograph as are necessary to make it compliant, or to require the Submitter to do so.
PHOTOGRAPH USES: Little League may use your photos in social media, on its website, in the World of Little League® Museum on posters and flyers for the promotion of photo submission, the Little League program or for use by third parties associated with Little League such as its sponsors, licensees, partners or agents as described in the Little League privacy policy.
There will be no winners or prizes associated with photo submission. We may contact the person that submitted the photograph for additional information to properly describe the photograph in any of the above uses.
GRANT OF RIGHTS: Each submitter retains ownership of the copyright in any Photograph, subject to the grants of rights contained herein. By submitting the Photograph, each submitter irrevocably consents, grants and gives permission to LLB and its associated sponsors, licensees, partners and agents, or to any entity it deems appropriate (all of the foregoing, the “Licensees”) to exploit, adapt, modify, reproduce, distribute, publicly display, publicly perform, use and authorize the use of the Submitter’s name, likeness (including without limitation photographs and/or recordings of the Submitter), voice and biographical information, and any Photograph submitted by the Submitter (collectively, the “Submitter Materials”), including without limitation modifying, altering, excerpting or amending the Photograph and/or creating derivative works based on the Photograph or any component thereof, for purposes of trade, publicity or promotion and any other purpose, in all media and formats whether now known or later developed, throughout the world in perpetuity.
Without limitation of the foregoing, each Submitter irrevocably agrees that the Licensees are permitted, upon entering a Photograph, to display the Submitter Materials online at the Website and other websites and/or social media platforms for public viewing and comment and to incorporate the Submitter Materials in publications (including without limitation Little League Magazine, the World of Little League Museum and other LLB publications), advertising, marketing and promotional materials and media releases and announcements (collectively, “Works”) for the Licensees and/or their respective products and services. By submitting a photograph, each submitter acknowledges and irrevocably agrees that the submitter will not be entitled to receive any credit, compensation, or notification whatsoever (other than as required by law) in connection with the grant of rights and releases herein or if any Submitter Materials are incorporated in any Works, or from any proceeds of any utilized Work incorporating any Submitter Materials.
RELEASE AND ASSUMPTION OF RISK: By entering, each Submitter, on behalf of the Submitter and his or her heirs, executors, guardians, assigns, agents and representatives, releases each of the Licensees and each of their respective parent companies, subsidiaries, affiliates and successors, and the directors, officers, employees and assigns of each of the foregoing, and all people and entities involved in the development or execution of the Photographs Submission including LLB, (the “Released Parties”), from and agrees not to assert any claims, actions, suits, proceedings and demands arising out of or relating to the conduct of or the submitters participation, the use of any Photograph by any of the Licensees or any other exercise by any of the Licensees of the rights granted herein, and all liabilities, losses, injuries and/or damages arising out of relating to the same. The foregoing includes, without limitation, any claims, actions, suits, proceedings or demands based upon or alleging any invasion of privacy, violation of right of publicity or infringement of any intellectual property or other personal or proprietary rights, or any personal injury or death to an Submitter or any other person or any damage to or loss of personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or any component thereof and any activity or travel related thereto or participation of Photograph Submission. Submitters assume all liability for and risk of any injury or damage caused, or claimed to be caused, by participation in this Photograph Submission.
The Released Parties are not responsible for late, lost, delayed, illegible, damaged, corrupted, or incomplete submissions, incorrect or inaccurate capture of, damage to, or loss of entries, Photographs or required information, any delay or interruption in the launch, accessibility or operation of the Website or any other human or technical errors of any kind relating to the submission, collection, storage or processing of entries or the administration of the Photograph Submission. The Released Parties are not responsible for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or e-mail client or for insufficient space in user’s e-mail account to receive e-mail. The Released Parties are not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. CAUTION: ANY ATTEMPT BY AN SUBMITTER TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, CONTEST ENTITIES RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. LLB reserves the right in its sole discretion to disqualify or prohibit from participating, any individual who LLB determines or believes, in their sole discretion, (a) has tampered with the entry process or has undermined the legitimate operation of the Photograph Submission, by cheating, hacking, deception or other unfair playing practices, or (b) has engaged in conduct that annoys, abuses, threatens or harasses any other Submitter or any representative of any Submitter or (c) has attempted or intends to attempt any of the foregoing.
LLB reserves the right, in their sole discretion, to modify this Photograph Submission Waiver and/or to cancel, modify or suspend the Photograph Submission process at any time in its discretion, including without limitation if a virus, bug, technical problem, fraud or misconduct, or other cause beyond the control of the LLB corrupts the administration, integrity, security or proper operation of the Photograph Submission process, or if for any other reason LLB is not able to conduct the Photograph Submission as planned (including without limitation in the event the operation of the Contest is interfered with by any fire, flood, pandemic, epidemic, earthquake, explosion, labor dispute or strike, act of God or of public enemy, communications failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, federal, state or local law, order or regulation or court order).
In the event of termination of the Photograph Submission process, a notice will be posted on the Website.
By submitting a Photograph per the Photograph Submission Waiver, (a) any and all disputes, claims, and causes of action arising out of or connected with the Photograph Submission shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (c) under no circumstances will any Submitter be permitted to obtain any award for, and Submitter hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Any legal proceedings arising out of this Photograph Submission shall be instituted only in the Court of Common Please, Lycoming County, Pennsylvania.
PRIVACY: Information collected in connection with the Photograph Submission will be subject to and may be used in accordance with the Privacy Policy posted on the Website (available at https://www.littleleague.org/privacy-policy/).
